Effective date: August 29, 2026

These Terms of Service (“Terms”) govern your access to and use of Tourism SF, including its articles, guides, forms, links, and other features. The website is operated by The Travel Spark Company LLC (“we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, do not use the website.

Independent informational guide

Tourism SF is an independent informational travel guide. It is not a governmental agency, an official tourism authority, a transit agency, a park authority, a venue, a hotel, a tour operator, or a booking provider. References to San Francisco, public agencies, landmarks, neighborhoods, cultural organizations, businesses, products, or services do not imply official status, sponsorship, endorsement, or affiliation unless we expressly state an independently verifiable relationship.

The website provides editorial information and planning ideas. It does not provide emergency, legal, medical, immigration, safety, financial, or professional advice. In an emergency, contact the appropriate local emergency service. For current operational information, contact the responsible agency, venue, business, or provider.

Eligibility and authority

You may use the website only if you can form a binding agreement under applicable law. If you use the website on behalf of an organization, you represent that you have authority to bind that organization to these Terms. The site is intended for a general audience and is not designed for unsupervised use by children who cannot consent under applicable law.

Information can change

We aim to publish useful, factual-neutral information, but travel conditions change. Transit service, routes, fares, schedules, weather, hazards, closures, admission rules, accessibility, menus, prices, availability, legal requirements, and provider policies may differ from what appears in an article or third-party result.

You are responsible for confirming time-sensitive information with the source that controls it before traveling, purchasing, or relying on it. A link, plugin result, or successful page load does not guarantee that a place is open, a route is safe or accessible for you, inventory is available, or a provider will perform as described.

Weather, terrain, coastal conditions, traffic, construction, and individual mobility needs can affect any route. Follow posted signs, closures, safety instructions, and lawful directions from responsible personnel. Do not enter a closed or restricted area to follow a suggestion or make a photograph.

Third-party products, bookings, and services

Tourism SF may link to or display tours, activities, hotels, transportation, tickets, maps, email services, or other products provided by third parties. Providers may include TravelSpark, Viator, Nuitee, and businesses or organizations identified in editorial content. We do not control their inventory, descriptions, prices, taxes, fees, ratings, reviews, schedules, accessibility, safety practices, availability, cancellations, refunds, payment processing, or customer support.

When you follow a provider link or complete a transaction on another website, you enter a separate relationship with that provider. Its terms, privacy policy, cancellation rules, and other conditions apply. Review them before purchasing. Direct booking questions, changes, cancellations, refund requests, traveler details, and payment disputes to the provider shown on your confirmation.

Tourism SF is not a party to a transaction merely because the provider result appeared on this website or an affiliate link was used. We do not hold traveler funds through the editorial website unless a future service clearly and expressly states otherwise under separate terms.

Affiliate disclosure

Some outbound links may be affiliate links. We may receive compensation when a qualifying action or purchase is attributed to such a link. This does not authorize us to alter the provider’s live price or availability, and it does not make provider statements our warranties.

Editorial inclusion is not a guarantee of quality, safety, suitability, or continued operation. We may add, change, or remove links and provider integrations without promising that every historical reference will remain available.

Acceptable use

You may use the website for lawful personal or internal informational purposes. You must not:

  • violate law or another person’s rights;
  • interfere with the site’s operation, security, or availability;
  • probe, scan, or test a vulnerability without written authorization;
  • bypass access controls, rate limits, or form protections;
  • introduce malware, harmful code, automated spam, or deceptive requests;
  • use automated means to extract content in a manner that places an unreasonable load on the service or violates applicable restrictions;
  • impersonate another person or misrepresent affiliation;
  • submit unlawful, threatening, abusive, defamatory, infringing, or intentionally false material;
  • collect personal information about others through the website without lawful authority;
  • use site content to create a misleading official affiliation with San Francisco or another organization; or
  • copy, frame, or republish substantial site content in a way that removes attribution, changes meaning, or substitutes for the website.

We may restrict or block access reasonably believed to threaten the site, users, providers, or others. A security control is not a promise that all harmful activity will be detected.

Intellectual property

The website and its original editorial content, visual design, logos, graphics, and code are owned by us or used under license and are protected by applicable intellectual-property laws. Third-party names, trademarks, photographs, artworks, maps, products, and other materials remain the property of their respective owners.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for lawful personal or internal informational purposes. No other right or license is granted by implication.

You may quote a short passage for commentary, criticism, education, or another lawful purpose when you provide appropriate attribution and do not imply endorsement. Any use beyond what law permits or these Terms authorize requires permission from the relevant rights holder.

“Tourism SF” and associated identity elements may not be used to imply that another website, service, or publication is ours or officially connected to us. City names and references to public places remain subject to their own legal status; our claim concerns our original presentation, not ownership of geographic facts.

User messages and submissions

If you send a correction, suggestion, accessibility report, technical report, or other message, you retain any rights you already hold in the original content you submit. You grant us a nonexclusive, worldwide, royalty-free license to receive, reproduce, review, store, and use the submission as reasonably necessary to respond, investigate, correct the website, protect rights, and operate the service.

You represent that you have the right to submit the material and that doing so does not violate law, confidentiality, privacy, or another person’s rights. Do not submit confidential business information, passwords, payment-card details, identity documents, or sensitive traveler information through a general contact form.

We are not required to publish a submission, adopt a suggestion, or provide individual editorial credit. If you report an image or rights concern, include enough information to identify the material and your relationship to the claimed right, but wait for an appropriate verification channel before sending sensitive documents.

Privacy

Our Privacy Policy explains how information is collected, used, disclosed, retained, and protected. By using the site, you acknowledge that Internet transmissions and storage systems cannot be guaranteed completely secure.

Accessibility

We aim to make the website’s theme-controlled interface and editorial patterns usable by a broad audience. Third-party widgets, provider pages, user-entered content, and external destinations may have different accessibility. If you encounter a barrier on Tourism SF, use the Contact page and identify the page, feature, device, browser, and assistive technology when you are comfortable doing so.

Website accessibility information does not guarantee the physical accessibility of a route, vehicle, building, trail, tour, or event. Confirm individual requirements with the responsible operator or managing agency.

No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

We do not warrant that the website will be uninterrupted, error-free, complete, current, or free of harmful components; that a route or destination will be safe, suitable, open, or accessible; that third-party content is accurate; or that a provider will honor a price, booking, representation, or request. Nothing in these Terms excludes a warranty that applicable law does not allow to be excluded.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE WEBSITE, THIRD-PARTY SERVICES, TRAVEL DECISIONS, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO US FOR THE WEBSITE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT OR ONE HUNDRED UNITED STATES DOLLARS.

These limitations apply to the extent permitted by law and do not limit liability that cannot lawfully be excluded or limited. Some jurisdictions do not permit certain exclusions, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our members, managers, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the website, your material breach of these Terms, or material you submit that violates another person’s rights.

This obligation does not apply to the extent a claim results from our own unlawful conduct, and it does not limit rights or protections that applicable law grants you.

Suspension and termination

You may stop using the website at any time. We may suspend or terminate access, remove a submission, or limit a feature when reasonably necessary to protect the website, enforce these Terms, comply with law, or prevent harm. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, indemnification, governing law, and dispute provisions, will survive.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction where The Travel Spark Company LLC is organized, without regard to conflict-of-law rules, except where applicable consumer law requires another result.

Before filing a formal claim, you agree to use the Contact page to describe the dispute and allow a reasonable opportunity for informal resolution, unless an immediate filing is necessary to preserve a legal right. Any court proceeding must be brought in a court with lawful subject-matter and personal jurisdiction. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims process where eligible.

Changes to the website or Terms

We may modify, suspend, or discontinue website content or features. We do not promise that a specific guide, provider integration, or link will remain available.

We may update these Terms to reflect changes in law, services, or practices. The effective date at the top identifies the current version. Material changes will receive additional notice when required. Your continued use after revised Terms take effect constitutes acceptance to the extent permitted by law; if you do not agree, stop using the website.

General provisions

These Terms and the Privacy Policy constitute the agreement between you and us concerning the website, except where a separate written agreement applies. If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of an organizational transaction or by operation of law. Headings are for convenience and do not limit meaning.

Contact

Questions about these Terms can be sent through the Contact page. The contact form is not a channel for emergency assistance, provider booking changes, or service of legal process unless applicable law requires otherwise.
